Insurance

Being an insurance law specialist and holding a master's degree in insurance law, Ms. Yvonne Gebert (née Maczkiewitz) is a lawyer in the insurance law and insurance regulatory law team that has been ranked in high positions by JUVE for years and was awarded the title "JUVE Law Firm of the Year for Insurance Law" in 2005 and in 2007. The team's width and depth of the specialisation and practical experience, coupled with an overall understanding of the economic interests of clients both inside and outside the insurance sector, is excellent.

Ms. Gebert's work includes advice on and litigation in all areas of private insurance law, insurance regulatory law and insurance mediation, in particular:

- Advice relating to loan insurance, life insurance, occupational disability insurance, health insurance (e.g., development of insurance terms and conditions, liability for negligent advice, pension liability insurance "gaps" in company pension plans, issues concerning the scope of insurance coverage)
- Advice and litigation in the area of insurance distribution law (e.g., implementation of the EU Insurance Mediation Directive in Germany: adapting mediation/broker agreements, advice on the obligation to register, liability issues) and advice for insurers and also for companies that could be considered insurance mediators/brokers because of the type of services they provide or the structure of their contracts
- Advice for foreign insurers and financial institutions, as well as international companies, with regard to the adaptation of their insurance products for the German market and/or the drafting of insurance mediation/broker contracts and/or commission commitments
- Carrying out insurance law due diligence investigations or answering individual questions concerning insurance law and/or mediation law with regard to transactions
- Advice and litigation in the area of transport (insurance) law and liability (insurance) law (e.g., asserting claims against the insurers of specie in transit for the cash-in-transit company HEROS owing to the insolvency of HEROS occurring in February 2006; advice and drafting of contracts for the disposal of cash and coins with other companies; reviewing the insurance coverage offered by such companies)
- Advice on all aspects of the new Insurance Contract Act that came into force on 1 January 2008, for example, newly designed products, especially relating to life insurance and liability insurance (amendments to insurance terms, application forms, redrafting of product information, etc.)


Memberships and Awards

- Listed in the JUVE Handbook 2008/2009 as "often recommended lawyer" for litigation, advice on insurance law (products, loss monitoring) and advice relating to corporate matters of insurers.
- Member of the Verein zur Förderung der Forschungsstelle für Versicherungswesen e.V., University of Münster: this research unit organises, among other things, numerous lectures, seminars, symposiums and workshops, as well as the annual insurance conference taking place in Münster (Münsterischer Versicherungstag).
- Member of the insurance law practice group in the German Lawyers Association.
- Member of the German-Australian Lawyers Association, DAUSJV e.V.

Resume

Studied law in Cologne. First state law exam in Cologne in 1997. Traineeship at Aachen Regional Court/Cologne Higher Regional Court, second state law exam and admission to the practice of law in 2000. From 1998 until the end of 2000 employed at the insurance law firm Sina Maassen in Aachen, first as trainee, subsequently as lawyer. Lawyer with CMS Hasche Sigle (formerly Norton Rose Vieregge) from 2001. Graduate of the post-graduate course of study insurance law at the University of Münster in 2005, master's thesis on "Die nicht nur als vorübergehend anzusehende Veränderung der Verhältnisse des Gesundheitswesens im Sinne des § 178 g Abs. 3 VVG" ("The Change in the Circumstances of the Health System Not to Be Considered Temporary in Terms of §178g(3) of the Insurance Contract Act"), degree: Master of Insurance Law (LL.M.). Insurance law specialist since 2009.
